Terms of use
These terms cover the WI.RUN website and current development version of the WI.RUN app, operated by KOMARSH LLC, Florida, United States. WI.RUN is in development. This site does not offer an App Store download, paid subscription, or live race registration.
1. Using WI.RUN
Use WI.RUN lawfully, responsibly, and in accordance with these terms. If you do not agree, do not use the service. If you are a minor, use it only with the permission and supervision required from your parent or guardian under applicable law. WI.RUN is not designed for children under 13.
Where an Apple-distributed version is offered, Apple's applicable terms and any applicable app license also apply. Nothing here overrides rights that cannot legally be excluded.
2. Running safely
WI.RUN is a fitness tool, not medical advice, an emergency service, or a guarantee of safety. Choose safe, permitted routes, follow traffic rules, be aware of your surroundings, and stop using the screen when it would be unsafe. Do not trespass or take risks to maintain a streak, earn points, or improve a result. Seek qualified medical advice when appropriate for your circumstances.
3. Accuracy and availability
GPS, distance, pace, timing, and recovery can be affected by device settings, reception, battery, network conditions, and software limitations. Metrics are estimates. A current local run is not a verified race result. Save your activity when finished; interrupted recordings may lose recent unsaved samples.
Development features can change or be discontinued. Live races, leaderboards, and wearable integrations described as planned or previews are not promises of current availability or a delivery date. No uptime or 100,000-user capacity guarantee is made.
4. Acceptable conduct
Do not misuse the site or app, attempt unauthorized access, introduce malicious code, interfere with others, impersonate someone, manipulate competitive results, or use location information to stalk or harass. If social features are introduced, additional community rules and reporting/blocking tools will apply before they become available.
5. Your data and privacy
The privacy policy describes current data practices and controls. You remain responsible for the information you choose to enter or send to support. Do not send sensitive information that is unnecessary to resolve an issue. Cloud accounts, optional run-summary sync and an opt-in weekly leaderboard are development features. Joining the leaderboard shares your handle, display name and weekly points with signed-in runners. Points are provisional and do not represent verified race results or prize eligibility. Cloud social posting and live racing are not deployed.
6. Intellectual property
WI.RUN's branding, software, and site materials are owned by KOMARSH LLC or their respective rights holders. You may use the service for its intended personal purposes; these terms do not grant ownership of those materials or permission to reuse branding commercially. Apple, Garmin, WHOOP, and other third-party names belong to their owners. Referencing a planned integration does not imply endorsement or partnership.
7. Disclaimers and responsibility
To the extent permitted by applicable law, development software and this website are provided as available without guarantees of uninterrupted operation or fitness for a particular purpose. KOMARSH LLC is not responsible for losses caused by misuse, unsafe running choices, or events outside its reasonable control, to the extent the law allows. Nothing excludes liability or consumer rights that cannot be excluded by law, including applicable rights relating to personal injury or misconduct.
8. Changes and governing law
We may update these terms and identify the revised date here; material changes will receive additional notice where required. Florida law governs these terms to the extent permitted, without displacing mandatory protections or rights available under the law where you live. We do not require arbitration or waive rights through these terms.
